Petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 302, 307, 323, 324, 325, 326, 333, 338, 427, 379 of IPC, Section 27 of Arms Act, Section 3/4 of Explosive Substance Act and Section 17 of the C.L.A. Act.
The FIR has been registered against 100 to 150 unknown extremists. The impugned order would reveal that during investigation it surfaced that the petitioner was member of the unlawful assembly. Petitioner has got no criminal antecedent. Investigation of the case is already complete. Considering the aforesaid material, there is no need for further detention of the petitioner as undertrial prisoner, hence, let the petitioner, above named, be released on bail on
Patna High Court CR. MISC. No.22408 of 2021(2) dt.31-08-2021 2/2 furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Adhaura Police Station Case No.25 of 2001 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
