The petitioner seeks bail in connection with Bhagwanpur Hat P.S. Case No.184 of 2016 registered under Section 379 of the Indian Penal Code.

The accusation is of committing theft of Bolero vehicle of the informant from his door in the evening of 31.10.2016. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the vehicle of the informant was found parked with punctured tyres at the bank of the canal and the petitioner was found present there. Further submission is that, in fact, the petitioner has been apprehended in the present case by the police

Patna High Court Cr.Misc. No.17609 of 2017 (2) dt.04-05-2017 2/2 on suspicion and, thereafter, the police got recorded his confessional statement about committing the theft of the vehicle of the present case and also his involvement in six other cases, as detailed in paragraph-3 to this application, and prior to that, the petitioner had no criminal antecedent. The petitioner is in custody since 01.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Bhagwanpur Hat P.S. Case No.184 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
