JUSTICE BIRENDRA KUMAR ORAL ORDER 12-03-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code alongwith Section 4 of the Dowry Prohibition Act.

The husband-Indrajeet Yadav has already been allowed regular bail by a Coordinate Bench of this Court in Cr.Misc.No.18622 of 2016 and some other co-accused, who are also relations of the husband, have been allowed anticipatory bail by another Coordinate Bench of this Court in Cr.Misc.No.46663 of 2018 vide Annexure-2.

In the aforesaid circumstance, I do not find any merit in the prayer of learned counsel appearing for the informant that he wants to file counter affidavit in this case bringing material to substantiate the allegation against the petitioners.

Hence, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Jehanabad Mahila P.S.Case No. 49 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond
