Patna High Court CWJC No.22280 of 2018(2) dt.06-01-2020 2/3 Heard learned counsel for the petitioner and learned counsel for the respondents.
Petitioner has prayed for the following relief: "(I) To constitute a high level committee to make proper enquiry in view of enquiry report dated 5.12.2017 given by Secretary, Food and Public Distribution, Ministry of Consumer Affairs, Department of Food and Public Distribution, Government of India as well as information given by many District Magistrates under the State of Bihar as no action has been taken in compliance of order dated 10.04.2018 passed in CWJC No. 6514/2018 consequently the quality foods supplied for poor peoples i.e. morsel the same has been sold perpetually through black marketing evident from paper publication dated 29.9.2018 in daily newspaper 'Dainik Bhaskar' and the poor people of State are compelled to take rotten food grains under National Food Security Scheme.
(II) For issuance of appropriate writ in the nature of Mandamus, commanding and directing the respondent authorities to direct the respondent to ensure adequate quantity of quality food at affordable prices to live with dignity as per preamble of National Food Security Act, 2013."
From the counter affidavit filed by the State, it is apparent that now a High Level Committee for examining the issue and taking appropriate consequential action already stands
Patna High Court CWJC No.22280 of 2018(2) dt.06-01-2020 3/3 constituted.
As such, in our considered view, with the passage of time the present petition may have become infructuous. As such, the present petition stands disposed of reserving liberty to the writ-petitioner or similarly situated persons to approach the appropriate authorities for redressal of his grievance, if any.
