Heard learned counsel for the petitioners and learned counsel for the State.

The submission on behalf of learned counsel for the petitioners is that the petitioners' case should be considered in terms of decision of this court in the case of Om Prakash versus The State of Bihar and Ors. decided in C.W.J.C. No. 6575 of 2009 and analogous cases.

The date of the judgment being relied upon by learned counsel for the petitioners is 06.10.2009. The relevant extract of the judgment relied upon is as follows:- "On consideration of submission of the parties and taking into consideration the facts of the case, I find that the impugned enquiry report has been prepared completely in violation of rule of natural justice. The authorities failed to consider that they are conducting enquiry in relation to permanent employees' appointment. For that proper course was to initiate a departmental proceeding and not to decide the nature of their appointment in absence of the employees. The authorities also ignored the relevant
10/11 government circulars which were in vogue at the time of petitioners respective appointment. While putting the petitioners in the category of forged appointee, the members of the enquiry committee have simply considered the dispatch register and not the signatures under which relevant appointment letters were issued. Signatures of the appointing authorities were not verified.
All these are the reasons for which the impugned enquiry report dated 31.12.2008 is quashed. The writ applications in which termination orders have been issued by the Civil Surgeon or any other authorities, those letters are also quashed. The respondents are directed to reinstate the petitioners on the post, they were working. Their reinstatement will be with effect from the date of their termination with all consequential benefits.
All writ applications are allowed."

The court has made a specific query from learned counsel for the petitioners whether the 163 petitioners who are before this court in the instant writ proceedings were permanent employees, or not. The answer specifically is in the negative. The basic fact for claiming parity with the petitioners in the case of Om Prakash (supra) is lacking, since those petitioners had been permanently appointed. The petitioners' case, therefore, is not at par with petitioners in the case of Om Prakash (supra). Petitioners, therefore, are not entitled to any direction for consideration in terms of the decision passed in the case of Om
11/11 Prakash (supra).

The other aspect of the matter is that relying upon decision rendered in the year 2009, the writ application claiming parity has been filed in the year 2023. The same is hopelessly barred by delay and laches as per the law laid down by the Hon'ble Apex Court in the case of Union of India and Others versus C. Girija and Others reported in (2019) 15 SCC 633. 6.
Writ petition is dismissed.
