The petitioner seeks bail in connection with Sherghati (Dobhi) P.S. Case No. 310 of 2019, registered under Section 30(d) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

The accusation is of recovery of 800 Kg mahua flower from the Sumo vehicle, which was being driven by the petitioner.

For a sake of argument, submission is that carrying the mahua flower would not come under the Bihar Prohibition and Excise (Amendment) Act, 2016. More so, the petitioner is in custody since 19.11.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on

Patna High Court CR. MISC. No.9972 of 2020(2) dt.27-02-2020 2/2 furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sherghati (Dobhi) P.S. Case No. 310 of 2019 to the satisfaction of the Special Judge, Excise, Gaya.
