JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-04-2021 Heard Mr. Surendra Kumar Singh, learned senior counsel for the petitioner, Mr. Anil Kumar Sinha, learned counsel appearing for the informant and Mr. Md. Aslam Ansari, learned counsel for the State through video conferencing. Petitioner seeks regular bail in connection with Imamganj P.S. Case No. 122 of 2019 registered for the offence under Section 341, 323, 324, 307, 379, 147, 149, 436 and 448 of the I.P.C.
The allegation as per the First Information Report is that petitioner along with 14 named accused persons and some unknown persons assaulted the informant and it is further stated that petitioner assaulted the informant by means of "lathi" and "tangi" on the head of the informant.

No.21765 of 2021(2) dt.26-04-2021 2/3 Learned senior counsel for the petitioner submits that both informant and the petitioner are full brothers and there is previous land dispute between them inasmuch as referring to Annexure - "2" to the petition learned counsel submits that proceedings under Section 144 of the Cr.P.C. are pending against the parties. Learned counsel further referring to Annexure - "3" to the petition submits that injuries caused to the informant are simple in nature as per the opinion of the doctor.
On the other hand, learned counsel for the informant vehemently opposes the prayer for bail and submits that altogether 15 persons including the petitioner brutally assaulted the informant and his other family members, as such, the petitioner does not deserve the privilege of bail. Having regard to the submissions made by learned counsel for the parties and taking into consideration the materials available on record, the fact that both the parties are full brother, there is land dispute between them, the injuries caused to the informant are simple in nature and the petitioner is in custody since 26.11.2020, as such, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be
Patna High Court CR. MISC. No.21765 of 2021(2) dt.26-04-2021 3/3 released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya in connection with Imamganj P.S. Case No. 122 of 2019.
It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
