JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code and section 3(1)(xii) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is of abducting the minor daughter of the informant. In 164 Cr.P.C. statement the victim has named the petitioner.
It is submitted by the learned counsel for the petitioner that due to petty dispute the accusation has been levelled. The girl was recovered from the house of Brajesh Yadav on 24.8.2014. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner in
Patna High Court Cr.Misc. No.6208 of 2016 (2) dt.09-02-2016 2/2 case the petitioner surrenders within six weeks from today in connection with Singhia P.S. Case No. 122 of 2014 pending in the court of learned S.D.J.M. Rosera, Samastipur. This application is disposed of with the aforesaid observation/direction.
