The petitioner seeks regular bail in connection with Rail Darbhanga (Sitamarhi) P.S. Case No. 107 of 2016 registered for the offences punishable under Sections 370, 374/34 of the Indian Penal Code and Section 79 of the Juvenile Justice Act.
The allegation is that this petitioner was found trafficking four children for using them as bonded labour in Mumbai.
Learned counsel for the petitioner submits that out of four, three children are resident of his village and one is his relative and they all were going to Mumbai where the fathers of
Patna High Court Cr.Misc. No.5976 of 2017 (2) dt.22-02-2017 2/2 children were residing at Mumbai. The mother of these children by sworn affidavit and denied the allegation of any trafficking of their children for any purpose. All the children have been handed over to the guardian and there is no antecedent against this petitioner. The petitioner is in custody since 03.12.2016. Learned APP for the State, on the other hand, opposed the submission.
Considering the nature of allegation, facts and circumstances as stated above, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Railway Judicial Magistrate, Samastipur in connection with Rail Darbhanga (Sitamarhi) P.S.
