This application has been filed for modification of the order dated 20.01.2023 passed in Cr. Misc. No. 34967 of 2022 by which the petitioners have been granted bail by this Court.
Learned counsel for the petitioners submits that the petitioners have been granted bail by this Court vide order dated 20.01.2023, but the bail bond of the petitioners could not be furnished due to condition No. 1, as imposed in the said order, therefore, learned counsel for the petitioners
Patna High Court CR. MISC. No.17703 of 2023(4) dt.19-04-2023 2/2 has confined his prayer to the extent that condition No.1 as imposed in the order dated 20.01.2023 may be deleted, Condition No.1 is as follows;.
"One of the bailor should be the father of the petitioners."
He further submits that the aforesaid condition may be deleted in view of the fact that the father of the petitioner, Vijay Singh @ Vijay has died on 04.04.2006 and the father of petitioner, Amar Singh has died on 10.05.2000. In view of the submission, the order dated 20.01.2023 stands modified and condition No.1 be read as "One of the bailors should be the close relative of the petitioners."
Accordingly, the modification application stands disposed of.
