The petitioner seeks bail in Chandauti P.S. Case No. 13 of 2017 corresponding to Sessions Trial No. 549 of 2016, registered for the offences punishable under Sections 498A and 304(B) of the Indian Penal Code.

The brother of the deceased made allegation that his sister was married to Rahul Pandey in the year 2011, but her husband, father-in-law, mother-in-law, brother-in-law and sisterin-law were torturing her. The informant tried to pacify the matter, but they continued to torture his sister due to non-fulfillment of demand of dowry. On 20.01.2017 the informant got information that his sister died due to hanging and saw the dead body of his sister lying on a cot.

Patna High Court Cr.Misc. No.12130 of 2017 (2) dt.18-03-2017 2/2 Learned counsel for the petitioner submits that the petitioner is the married sister-in-law of the deceased. The petitioner has no manner of concern with the family affairs of the deceased and her husband. The petitioner is living in her Sasural with her husband and three children. Omnibus and general allegation has been made against the petitioner that too after six years of the marriage of the deceased.

Considering the facts aforesaid and the fact that the petitioner is married sister-in-law of the deceased, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Chandauti P.S. Case No. 13 of 2017 corresponding to Sessions Trial No. 549 of 2016.
