The petitioner seeks bail in Kanti P.S. case No. 415 of 2016 under Section 457, 380 of the Indian Penal Code. The informant lodged the case against unknown for theft in her house. The petitioner is not named in the FIR. The petitioner was arrested in Ahiyapur P.S. case 618 of 2016 with stolen motor cycle of a different case and the petitioner is alleged to have confessed his guilt but no stolen article of the present case has been recovered from his possession. The petitioner is in jail since 08.11.2016.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.11647 of 2017 (3) dt.08-04-2017 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, West, Muzaffarpur in Kanti P.S. Case No. 415 of 2016.
