JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-03-2015 Heard learned counsels for the petitioners, informant and the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 452, 341,323, 468, 504 and 379/34 of the Indian Penal Code.
The accusation is of assaulting the informant with fists and Lathi in the background of land dispute.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general and from accusation levelled in the F.I.R. it appears that the petitioners have no intention to kill to the informant. A statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.9178 of 2015 (2) dt.10-03-2015 2 / 2 informant that two injuries have been found to be grievous.
Considering the fact that the accusation of assault is omnibus and general in the background of land dispute, let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks from the date of receipt/production of copy of the order in connection with Katihar Town (Sahayak) P.S. Case No. 245 of 2014 pending in the court of the learned C.J.M. Katihar.
With this observation, the application is disposed off.
