The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code. It is alleged that all the F.I.R named accused persons including the petitioner have abducted the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in
Patna High Court CR. MISC. No.11657 of 2022(3) dt.03-11-2022 2/3 this case only on the basis of suspicion. Moreover, for the alleged occurrence of 16.08.2019, the F.I.R has been registered on 22.08.2019 without explaining the delay. It is further submitted that other similarly situated co-accused persons have been granted anticipatory bail by a coordinate Bench of this Court vide order dated 14.07.2021 passed in Cr. Misc. No. 35258 of 2020. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IX, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 297 of 2019, subject to the conditions as laid down under Section 438(2) of the
Patna High Court CR. MISC. No.11657 of 2022(3) dt.03-11-2022 3/3 Cr.P.C.
