The petitioners seek bail in connection with Neemachandpura P.S. Case No. 123 of 2023 instituted for the offence under Sections 302, 120(B), 506 & 34 of the Indian Penal Code.

Prosecution case in short is that wife of the informant was done to death at her matrimonial house. 4.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 09-10-2023. Petitioners are stated to be man of clean antecedent.

It has been further submitted by the petitioners'

Patna High Court CR. MISC. No.13753 of 2024(2) dt.06-03-2024 2/2 counsel that petitioners have been falsely implicated in the present case. There is delay in lodging of the FIR. It is submitted that deceased developed illegal relation with the Rahul Kumar, but when her family members objected, then she committed suicide. Referring to the impugned order, it is submitted that cause of death is due to asphyxia as a result of injuries caused by strangulation. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners, clean antecedent of the petitioners and charge sheet being submitted, this Court is inclined to grant bail to the petitioners. 8.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Neemachandpura P.S. Case No. 123 of 2023.
