JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 427 and 379 of the Indian Penal Code.

The prosecution case is of committing theft of ten bags of cement and two quintals of iron rod for protesting against the construction of community hall.

It is submitted by learned counsel for the petitioners that the petitioners were roped in the present case since they made protest for construction of community hall in a pound obstructing the public utility and the matter was travelled up to this Court in a writ petition being C.W.J.C. No. 1174 of 2015 which was

No.6656 of 2016 (2) dt.12-02-2016 2/2 disposed of with liberty to the writ petitioners to file detail representation before the District Magistrate and District Magistrate was to dispose of the same in accordance with law within period of three months from the date of receipt of such representation, hence in the said background, the case was lodged. For the occurrence of 04.08.2015 at 11 PM, the FIR was lodged on 05.08.2015 at 4.30 PM. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class Bikramganj (Rohtas) in connection with Dinara (Bhanas) P.S. Case No. 271 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
