JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2019 The petitioners seek bail in anticipation of their arrest in connection with Majorganj P.S. Case No. 178 of 2016 dated 08.07.2016 instituted for the offences under Sections 341, 342, 323, 308, 379, 504, 34 of the Indian Penal Code.

It has been alleged that the petitioners dragged the informant to the house of another person where he was assaulted severely.

The learned counsel for the petitioners has submitted that the F.I.R. has been lodged after twelve days of the occurrence and the injuries suffered by the informant

Patna High Court CR. MISC. No.12153 of 2019(2) dt.05-03-2019 2/2 are only in the nature of bruises and abrasions on chest and shoulders caused by hard and blunt substance. The cause of occurrence, it has been argued, is that the informant had tried to outrage the modesty of the daughter of petitioner No. 1 for which some scuffle had taken place. The petitioners as well as informant are neighbours.

Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 178 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
