JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. The petitioners seek bail in connection with Chakai P.S. Case No. 259 of 2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Sections 30(a) and 41 of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 18.12.2021, are persons with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 178.875 litres of liquor from a Hyundai car.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.11704 of 2022(2) dt.11-03-2022 2/2 petitioners have been falsely implicated in the case, the petitioners are neither the owner nor the driver rather were passerby and in order to save the real culprits, the petitioners have been falsely implicated.

Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent and charge-sheet has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Jamui in connection with Chakai P.S. Case No. 259 of 2021.
