JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-02-2019 The petitioner seeks bail in anticipation of his arrest in connection with Excise Cased No. 1172 of 2018, arising out of Madhepura P.S. Case No. 768 of 2018 dated 17.09.2018 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Considering the fact that the recovery has been made from a room of the hostel which the petitioner denies to be his room, this Court is not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail of the petitioner stands rejected.

In case the petitioner surrenders before the Court

Patna High Court Cr.Misc. No.11180 of 2019(2) dt.25-02-2019 2/2 below and seeks bail, the Court below shall take into account that petitioner has clean antecedents and shall pass orders in accordance with law without being prejudiced by the fact that the present petition for anticipatory bail has not been entertained.
