The petitioner apprehends his arrest in Aurangabad (Muffasil) P.S. Case No. 210 of 2019, registered for the offences punishable under Section 153(A) of the Indian Penal Code. Allegation against the petitioner is that he sent objectionable message and video through his Whatsapp (mobile no. 7277985758) to a Whatsapp group namely Islamic Thinking which is likely to cause damage to the communal peace and tranquility.
It is submitted that petitioner is not named in the FIR. Name of petitioner transpired in the case after one and half year of the occurrence as the mobile no. 9031878126 was registered in the name of petitioner. In fact, the said mobile was lost in the
Patna High Court CR. MISC. No.12546 of 2022(2) dt.16-08-2022 2/2 way while the petitioner was going to appear in untrained teacher examination. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Muffasil) P.S.
