The instant application for anticipatory bail has been

Patna High Court CR. MISC. No.21807 of 2021(2) dt.22-12-2021 2/3 filed by the petitioners apprehending their arrest in connection with Saur Bazar (Patarghat O.P.) P.S. Case no. 121 of 2020 instituted for the offence punishable under Sections 147, 148, 149, 341, 323, 327, 379, 353, 307, 427, 337, 338, 333,504, 506 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case relates to unlawful assembly of the accused persons along with others at Patarghat Chowk and pelted stones and created ruckus with the police party while they are discharging their official duties.

Learned counsel appearing on behalf of the petitioners has submitted that petitioner is innocent and has been falsely implicated in this case. It is further submitted that there is general and omnibus allegation against the petitioners. Petitioners have no criminal antecedent.

Learned APP for the State has opposed the prayer of bail.

Having heard learned counsel for the parties and the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Saur Bazar (Patarghat O.P.) P.S. Case No. 121

Patna High Court CR. MISC. No.21807 of 2021(2) dt.22-12-2021 3/3 of 2020, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
