2. The petitioner is seeking regular bail in connection with Special Case No. 165 of 2023 arising out of Pirbahore P.S. Case No. 446 of 2023 for the offences punishable under Sections 22(b) of the NDPS Act.

3. As per allegation, 50 ample injection of 2 ML of Pheniramine Maleate injection, red colour Avil, 45 ample injection of 2 ML of Burenorphine blue colour leegisic and two mobile phones have been recovered from the possession of petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the medicines which

No.24510 of 2024(5) dt.06-09-2024 2/2 were recovered from possession of the petitioner are not the psychotropic substance, rather he was carrying it to supply in rural area. The petitioner is under custody since 18.06.2023. He has also submitted that the petitioner has no any other case of similar nature.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV Patna in connection with Special Case No. 165 of 2023 arising out of Pirbahore P.S. Case No. 446 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
