The Petitioner seeks bail in Lalganj P.S. Case No. 114 of 2015 instituted for the offence under Section(s) 363, 365, 376, 302 of the Indian Penal Code and Sections 4, 6 of the Protection of Children from Sexual Offences Act. As per prosecution case, on the date of occurrence, on the occasion of marriage, the generator light, all of a sudden was cut. In the meantime, daughter of the informant namely Saraswati Kumari became disappeared and she could not be found out after search. The dead body of daughter of the informant was later on found after one day in a plastic box. The case diary has been received.

Patna High Court Cr.Misc. No.11535 of 2017 (4) dt.24-04-2017 2/2 Learned A.P.P. has submitted that in paragraphs 50, 51 of the case diary and in para 16 of the supplementary case diary, the suspicion has been raised against this petitioner. From the impugned order also, it appears that mere suspicion has been raised against this petitioner. The petitioner is said to be in custody since 22.10.2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 114 of 2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
