The petitioner seeks bail in Shankarpur P.S. Case No. 127 of 2016, registered for the offences punishable under Sections 341, 342, 323, 452, 354B, 366, 380, 420, 504, 506, 509 and 34 of the Indian Penal Code.
The informant alleged that while she was at the house of her maternal grand father the accused persons including the petitioner came and the accused persons assaulted the informant and others to forcibly marry her with Monu Kumar Yadav. Monu Kumar Yadav took her to Delhi and left her on railway station. Learned counsel for the petitioner submits that the petitioner took part in Panchayati therefore he has falsely been implicated in the case. The informant was earlier married to
Patna High Court Cr.Misc. No.12605 of 2017 (2) dt.11-04-2017 2/2 someone else but she had relation with Monu Kumar Yadav and that is why the villagers took part in Panchayati and asked the informant and Monu Kumar Yadav to solemnize the marriage. Considering the facts and nature of allegations made against the petitioner, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, Madhepura in Shankarpur P.S. Case No. 127 of 2016.
