The sole petitioner, apprehending her arrest in connection with Mohania P.S. Case no.211/2015 registered for the offence under Sections 341, 323, 307, 302/34 of the Indian Penal Code, has prayed for grant of anticipatory bail. By way of referring to F.I.R. as well as Annexure-5 series to the present petition, learned counsel for the petitioner submits that other two accused persons having similar accusation have been extended the privilege of anticipatory bail. He submits that the case of the petitioner is exactly similar to the accused persons, who have been granted anticipatory bail. It was argued

Patna High Court Cr.Misc. No.5816 of 2016 (2) dt.22-02-2016 2/2 that among two one is male person and another is lady. I have perused the material available on record as well as Annexure-5 series. In view of fact, particularly the fact that exactly on similar accusation, two other accused persons have been extended the privilege of anticipatory bail, there is no ground to refuse the same prayer of the petitioner. Accordingly, let the petitioner, namely, Basanti Devi, in the event of her arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur( Bhabua) in connection with Mohania P.S. Case no.211/15 , subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
