In this case, the petitioner is seeking anticipatory bail in connection with Sadar P.S. Case No. 700 of 2018, registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Allegation has been made that 5 litres of country made liquor has been recovered from the joint house of the petitioner.

Though the petitioner has a criminal antecedent, but looking to the quantity of the recovered liquor, this Court is inclined to grant bail to the petitioner, let the above-named petitioner, be released on anticipatory bail in the event of his

No.11047 of 2019(2) dt.25-02-2019 2/2 arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum- Special Judge, Hajipur at Vaishali, in connection with Sadar P.S. Case no. 700 of 2018 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases, then the cornered Court below would be at liberty to take steps for cancellation of his bail bonds.
