The petitioner seeks bail in N.D.P.S. Case No. 09 of 2018 arising out of Excise Case No. 109 of 2018 registered under Sections 18(b) and 8(c) of the NDPS Act as well as Sections30(a) & 56(d) of Bihar Prohibition and Excise Act. Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that 23 kg. opium was recovered and as per Section-37 of the NDPS Act, the petitioner is not entitled for bail. A report was called for from the trial court. It has been reported that out of 9 prosecution witnesses, one prosecution witness has already been examined.

Patna High Court CR. MISC. No.22340 of 2021(3) dt.08-09-2021 2/2 Considering the nature of allegation and stage of the case, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. Learned trial court is directed to take necessary steps to conclude the trial as early as possible preferably within a period of six months from the date of receipt/production of copy of this order.
