19-02-2016 Heard Sri Arun Kumar Mandal, learned counsel for petitioners and Mr. M. Rab, learned Addl. Public Prosecutor. Two petitioners, who are own sister and husband of own sister of the informant respectively apprehending their arrest in Narpatganj P.S. Case No. 336 of 2014 registered for the offence under Sections 341, 326 and 34 of the Indian Penal Code, have prayed for grant of anticipatory bail.

Learned counsel for petitioners submits that the informant, due to some family dispute, has falsely implicated his own sister, who is petitioner no. 1 and own sister's husband (petitioner no. 2). The informant is a drunkard and only with a view to extract money, false case has been lodged. Besides hearing, I have also perused the materials

Keeping in view the nature of accusation and relation of informant with petitioners, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, in the event of their arrest or surrender within a period of six weeks from today before the court below, let the petitioners namely Kiran Devi and Baidhanath Mehta be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, Distt. Araria in connection with Narpatganj P.S. Case No. 336 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
