Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a),36,38 of the Bihar Prohibition and Excise Act, 2016.

192 liters of cough syrup containing codeine was recovered from the vehicle of the petitioner. The petitioner was not there at the time of recovery. Driver and others were apprehended at the time of recovery. Petitioner has got an identical criminal antecedent. There is no material to substantiate that petitioner is going to tamper with the evidence or hamper the trial.

Considering the entire facts, let the petitioner, above

Patna High Court CR. MISC. No.15021 of 2020(2) dt.04-03-2020 2/2 named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Palasi P.S.Case No.313 of 2017 (Special Case No.3105 of 2017), subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
