The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 3,4,5 of the Immoral Traffic(Prevention) Act. The prosecution case as per F.I.R is that on getting information that business of prostitution is going on at hotel Dayal, Exhibition Road, Patna, raid was conducted and several girls and boys were found in separate rooms in compromising position. Some

Patna High Court CR. MISC. No.11892 of 2022(2) dt.31-08-2022 2/3 objectionable items were also seized from the hotel. The Manager of the hotel was apprehended who confessed the name of the petitioner and stated that petitioner used to supply prostitutes in the hotel.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. During investigation, no direct or indirect evidence has been collected against the petitioner and merely on the confession of the co-accused, the petitioner has been dragged in the present case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Class,
