The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 447,323,379,354, 308, 504 and 506/34 of the Indian Penal Code.

It is alleged that all the accused persons entered into the courtyard of the informant and caught hair locks of Anita Devi and tried to take her away when it was objected, they assaulted the informant and informant's wife and daughter with Lathi and Danda. In course of incident, petitioner nos. 3 and 4 took silver Hasuli and locket of the informant's daughter worth Rs. 50,000/-.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.10691 of 2015 (2) dt.17-03-2015 2 / 2 petitioners that for petty dispute, accusation has been levelled when accusation is omnibus and general. The statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent and the informant has retracted from his initial version and filed a petition to that effect before the learned court below.

Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Nawhatta P.S. Case No. 186 of 2014, on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
