JUSTICE SHAILENDRA SINGH ORAL ORDER 18-11-2025 At the outset, learned counsel appearing for the petitioner submits that though the instant writ application has been filed with a prayer to direct the respondent no. 5, the Circle Officer, Sandesh, Bhojpur to return the petitioner's original Land Possession Certificate (LPC) which had been taken by the said respondent in fraudulent manner under the false pretext and after filing this writ application, from the annexure-D to the counter affidavit filed by the State it comes in the knowledge of the petitioner that the respondent no. 5 has cancelled the Land Possession Certificate which had been issued in favour of the petitioner without giving any opportunity of hearing to the

Learned counsel for the petitioner submits that since the petitioner's writ petition has now become infructuous because the original Land Possession Certificate, for which return a prayer is made in this application has already been cancelled, however, the petitioner wants to challenge the order of the respondent no. 5 by which petitioner's Land Possession Certificate has been cancelled, so, in this regard, petitioner may be given a liberty.

Considering the aforesaid submission, the instant writ petition stands disposed of as being infructuous, however, the petitioner will have a liberty to challenge the order of respondent no. 5 by which his Land Possession Certificate has been cancelled under the prevalent revenue laws. If the petitioner avails this liberty within the next six weeks then the time spent by the petitioner in this writ application shall be excluded while computing the necessary limitation period.
4. This writ petition stands disposed of with the aforesaid liberty.
