JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341,323,384,504,506386/34 of the Indian Penal Code. As per the prosecution case, while the informant was returning home with his wife and reached near Krishna Bhawan Clubn Road, all the FIR named accused persons including the petitioners stopped his car. Thereafter, co-accused Razi Ahmad told that he is Rangdar and does what he says and asked for his post dated cheques of Rs.90 lacs which he has given him. Accused persons also assaulted the informant. Learned counsel appearing for the petitioner submits that in fact, due to previous enmity, wife of co-accused Razi Ahmad had lodged Complaint Case No. 428 of 2022 against the
Patna High Court CR. MISC. No.15445 of 2023(2) dt.18-05-2023 2/2 informant on 23.3.2022, thereafter this false case has been lodged on 5.9.2022. Co-accused Razi Ahmad and other coaccused have already been allowed pre-arrest bail by a coordinate bench of this Court vide order passed in Cr.Mis.No. 9016/2023. Petitioner claims clean antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class Muzaffarpur East in Mithanpura Police Station Case No. 295 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
