JUSTICE ARVIND SRIVASTAVA ORAL ORDER 01-02-2022 At the outset, learned counsel for the petitioners submits that petitioner no. 3 has been arrested during pendency of the application, and as such, he seeks permission to withdraw this application as against him. Permission is granted.

The application, thus, stands dismissed as withdrawn as against petitioner no. 3.

Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in connection with Muffasil P.S. Case No. 100 of 2020 registered for the offence

Patna High Court CR. MISC. No.21755 of 2021(3) dt.01-02-2022 2/2 punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. Similarly situated co-accused has been granted bail by different co-ordinate Benches of this court vide orders dated 23.06.2021 and 30.07.2021 passed in Cr. Misc. No. 41151 of 2020 40966 of 2020. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate, XIII, Gaya in connection with Muffasil P.S. Case No. 100 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
