The petitioner seeks regular bail in connection with Session Trial No. 373/21 arising out of Karja P.S. Case No. 35 of 2020 lodged under Sections 498 (A), 307/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is the Bhaisur of the deceased. The husband of the deceased is already in custody. He further submits that from Annexure-2 and Annexure 2/1, it is very much clear that petitioner has separate establishment than the husband of deceased. He further submits that Charge-sheet has already been filed, charge has already been framed and also informed that petitioner is in custody since 09.08.2021 having clean antecedent. He further
Patna High Court CR. MISC. No.12241 of 2022(2) dt.30-06-2022 2/2 submits that the other co-accused (father-in-law of the deceased) has been granted regular bail by the Coordinate Bench of this Court vide order dated 23.12.2021 passed in Cr. Misc. No. 29958 of 2021(para 15).
Learned APP for the State opposes the prayer for bail. Considering the facts and circumstances that the petitioner has separate establishment and the husband of deceased is already in custody and also after considering the period of custody and charge has already been framed as well as petitioner has no criminal antecedent, let the petitioner above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- ( Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 18th Muzaffarpur in connection with Session Trial No. 373/21 arising out of Karja P.S. Case No. 35 of 2020, subject to the conditions as laid down under Section 437(3) of the Cr. P.C.
