JUSTICE RAKESH KUMAR ORAL ORDER 19-02-2016 After some argument, Sri Sheo Kumar Prasad, learned counsel for the petitioners, in presence of Sri Ambika Bhagat, learned Special Public Prosecutor, makes a prayer for disposal of the present anticipatory bail petition, so that the petitioners may appear before the court below and make a prayer for regular bail. It has been argued that it was completely a false case and only with a view to restrain the petitioners for getting the privilege of anticipatory bail, the provision of Section 3(i) (x) of SC/ST Act has been incorporated in the F.I.R.
In view of facts and circumstances, the present anticipatory bail petition is disposed of with an indication that if
Patna High Court Cr.Misc. No.5738 of 2016 (2) dt.19-02-2016 2/2 the petitioners appear before the court below within six weeks from today and make a prayer for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in view of facts disclosed in the F.I.R. itself preferably on the same day.
