The petitioner apprehends his arrest in Revilganj P.S. Case No 242 of 2019 Registered for the offences under sections 188, 189, 272, 273, 341, 323, 307, 353, 427/34 of the Indian Penal Code and Sections 30, 38, 41, 45 and 48 of the Bihar Prohibition and Excise Act, 2016.

10 litres of countrymade wine is said to be kept hidden in the bag of co-accused Amardeo Singh. Learned Counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. Mandatory provisions under Section 100 Cr.P.C has not been followed with regard to seize and seizure. Petitioner has clean antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.13035 of 2020(2) dt.04-03-2020 2/2 well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned XI A.D.J.-cum-Special Judge, Excise, Saran in connection with Revilganj P.S. Case No. 242 of 2019 , subject to the conditions as laid down under Section 438(2) of Cr.P.C.
