The petitioner is accused in connection with Kanti P.S. Case No. 868 of 2019, registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code and Section 37(c) of the Bihar Excise Act.
The accusation is that in course of patrolling duty, informant received information to the effect that one boy in drunken state creating nuisance beneath the Narsanda overbridge then informant along with other police personnel reached there. On seeing the police party, the boy started to flee away but on chased, he was caught hold, who disclosed his name as Niraj Kumar (petitioner). On search, one knife and Debit card
Patna High Court CR. MISC. No.9817 of 2020(2) dt.28-02-2020 2/2 were recovered from possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 27.11.2019. Further submission is that while petitioner is accused in Kanti P.S. Case No. 40 of 2017, but in that case, he is on bail.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur, in connection with Kanti P.S. Case No. 868 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
