JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2022 Supplementary affidavit is being filed on behalf of the petitioner making correction in paragraph 1 of the bail petition. Let the same be kept on record.

Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code, u/s 3/5 Explosive Substance Act and u/s 16/17/18/20/21/22 of the UAP Act. As per the prosecution case, on the disclosure made by co-accused, who was apprehended on the spot, one camouflage uniform, one powergel explosive (25 mm x 125 gm.) and two camouflage caps were recovered from the house of this petitioner.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.12197 of 2022(3) dt.16-05-2022 2/2 that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner claims clean antecedent and is in custody since 01.09.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Jamui in connection with Laxmipur PS case No.289/2021.
