The learned counsel for the State is present. The petitioners have challenged the order dated 31.10.2014 passed by learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in Trial No. 3380 of 2014, arising out of Shrinagar Pujaha P.S. Case No. 31 of 2014 whereby cognizance has been taken against the petitioners under Sections 147, 341, 323, 379, 504, 34 of the Indian Penal Code.
Patna High Court CR. MISC. No.16420 of 2015(3) dt.15-05-2019 2/2 In the absence of the learned counsel for the petitioners, this Court is not in a position to know about the stage of the case. However, on going through the order impugned as well as the materials in the present petition, this Court is not inclined to interfere with the order of cognizance.
The petitioners would be at liberty to approach the Court below and seek discharge, if such petition has already not been filed and disposed off. If the case is running trial, the Trial Court shall conclude the proceedings as early as possible.
With the aforesaid observation, the petition stands disposed off.
