22-02-2016 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Araria P.S. Case No. 335 of 2015 registered for the offence under Sections 406, 409, 420 and 120B of the Indian Penal Code, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that the petitioner is a Panchayat Teacher and he was entrusted with the work of construction of some government buildings and it was alleged that the petitioner without executing the work, has withdrawn money and misappropriated the same in connivance with other accused persons. He submits that actually some work was done, but without proper measurement, the petitioner has been

Besides hearing, I have also perused the materials available on record. It is a case of misappropriation of nine lakh and odd. The petitioner has functioned as an agent for executing the work. The allegation is for misappropriating the government fund in connivance with other accused persons. In view of nature of accusation, I do not find any ground for extending the privilege of anticipatory bail. The petition stands dismissed.
