The petitioner seeks bail in Chapra Muffasil P.S. Case No. 13/2017, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30, 38 and 41 of Bihar Prohibition Excise Act, 2016.

Three persons were going on motorcycle and after seeing the police they started to flee away. Two persons Ashok Kumar and the petitioner were apprehended. 40 litres of country made liquor was recovered from the motorcycle kept in a tube and from possession of the petitioner 30 pouches, each containing 200ml, country made liquor were recovered.

It is submitted that 6 litres country made liquor was recovered from possession of the petitioner. The petitioner is in

Patna High Court Cr.Misc. No.12487 of 2017 (2) dt.22-03-2017 2/2 jail since 20.01.2017.

Considering the facts aforesaid and the fact that the petitioner has remained in jail for two months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 13/2017.
