2. The petitioner seeks bail in connection with Dev P.S. Case No. 187 of 2023 instituted for the offences punishable under Sections 147, 149, 341, 323, 324, 307 of the Indian Penal Code.

3. The petitioner is said to have assaulted the cousin of the informant by means of knife due to which he sustained injury.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner and no specific overt act is alleged against him. Charge-sheet has been

Patna High Court CR. MISC. No.14822 of 2024(3) dt.13-05-2024 2/2 submitted in this case. No incriminating article has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 29.07.2023 and has no criminal antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail after framing of charge, if not already framed, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Dev P.S.
