JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-10-2022 The District Magistrate, Patna, has filed a counter affidavit in the present case, wherein it has been stated that no final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, (hereinafter referred to as the "Act, 1956") has been passed in connection with Land Encroachment Case No. 3 of 2018-19, hence it is submitted by the learned counsel for the respondent-State that the petitioner be directed to file her objection/ reply in the aforesaid ongoing encroachment proceedings whereupon the Circle Officer, Athmalgola, Patna shall take a final decision and pass appropriate orders under Section 6(1) of the Act, 1956. Accordingly, the present writ petition stands disposed off with a liberty to the petitioner to file her objection/reply under Section 6(1) of the Act, 1956, if so advised, within a
Patna High Court CWJC No.22849 of 2018(3) dt.11-10-2022 2/2 period of four weeks from today, whereupon the Circle Officer, Athmalgola, Patna, shall consider the same and pass appropriate orders under Section 6(1) of the Act, 1956, within a period of 12 weeks thereafter.
