This application for regular bail arises out of Deoria P.S. Case No. 79 of 2020, disclosing offence punishable under Section 392 of the Indian Penal Code.

The FIR was registered against unknown. Learned counsel appearing on behalf of the petitioner has drawn my attention to the two orders of this Court dated 15.11.2021, passed in Cr. Misc. No. 19640 of 2021 and 22.10.2021, passed in Cr. Misc. No. 27739 of 2021, whereby in similar circumstance co-accused Kamal Kishore Rai and Mukesh Kumar Yadav have been granted privilege of regular bail. The petitioner is in custody since 09.11.2020.

Patna High Court CR. MISC. No.22586 of 2021(3) dt.29-11-2021 2/2 Learned counsel appearing on behalf of the petitioner has submitted that the petitioner's case is identically situated with that of other co-accused who have been granted regular bail by this Court.

Learned Additional Public Prosecutor appearing for the State, on the other hand, has submitted that the petitioner has one criminal antecedent, as is evident from the statement made in paragraph-3 of the application. She has, however, not been able to distinguish the case of the petitioner with that of those who have been allowed regular bail by this Court. Considering parity, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned J.M. Ist Class (West), Muzaffarpur in Deoriya P.S. Case No. 79 of 2020. (Chakradhari Sharan Singh, J) Rajesh/- U T
