23-06-2020 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Kanhauli P.S. Case No. 107 of 2016 registered for the offence under Sections 341, 323, 324, 325, 307, 504 of the Indian Penal Code.

In the FIR, the allegation against the petitioner is that he gave farsa blow on the head of informant's wife, as a result of which, her head was cut and blood started oozing out from her head.

It is submitted on behalf of petitioner that petitioner has falsely been implicated due to land dispute. There is case and counter case between the parties and only with a view to put pressure on petitioner's side, the present case has been lodged. However, from perusal of material available on

Patna High Court CR. MISC. No.11310 of 2020(2) dt.23-06-2020 2/2 record, it appears that there is specific allegation of assault against this petitioner by farsa. The doctor has also found the injury to be grievous and dangerous to life and caused by sharp cutting weapon, which is measuring 21⁄2" X 1⁄2" bone deep over skull.

In view of aforesaid facts, I am not inclined to extend the privilege of anticipatory bail to the petitioner. The anticipatory bail application stands dismissed. (Prabhat Kumar Singh, J.) anay U T
