2. Petitioner apprehends arrest in Kawakole P. S. Case No. 434 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(2), 109, 103(1), 352, 3(5) of the Bharatiya Nyaya Sanhita.
3. It is alleged that this petitioner along with two other F.I.R. named accused persons brutally assaulted the husband of informant by means of axe, lathi, etc. as a result of which he sustained injury and died during course of treatment.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner has falsely been implicated in this case due to land dispute.
Patna High Court CR. MISC. No.11142 of 2026(5) dt.13-07-2026 2/2 Allegation against petitioner is general and omnibus.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application and submitted that there is specific and direct allegation that this petitioner along with other accused persons assaulted the deceased. Injury sustained by the deceased were found to be grievous and petitioner has got three criminal antecedents.
6. Considering the nature of accusation and criminal antecedents, prayer for anticipatory bail of the petitioner is refused.
