JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 8,15,17,18,25,29 of the NDPS Act.
As per the prosecution case, 14.10 kg doda powder was recovered from beneath the seat of the truck driver. Learned counsel appearing for the petitioner submits that the petitioner is neither driver nor the owner of the truck in question. Petitioner has been implicated in this case because he is one of the three directors of Jugnu Heavy Logistic Private Limited and he was authorized by rest two directors by special power of attorney to apply for release of alleged seized truck on behalf of the said Limited company. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I cum Special Judge, NDPS Act, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
