JUSTICE SANJAY PRIYA ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 363 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is not named in the FIR. The name of the petitioner has come in course of investigation in para 17 of the case diary, on the basis of another fardbeyan of the informant wherein she has stated that she learnt that her son was done to death by this petitioner with the help of Bibek Kumar, Ranjit Kumar and Bhola Rai. It has been submitted that Bhola Rai has been granted anticipatory bail by a coordinate bench of this Court on 01.05.2017 in Cr. Misc. No. 16776 of 2017.

Learned counsel for the State has submitted that merely

Patna High Court Cr.Misc. No.5928 of 2017 (3) dt.15-05-2017 2/2 suspicion has been levelled against the petitioner. Considering the aforesaid facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in Barauni (Refinery) P.S.Case No. 320 of 2016,subject to the condition that both bailors will be close relative of the petitioner.
