JUSTICE SUDHIR SINGH ORAL ORDER 21-05-2015 The petitioner is apprehending his arrest in connection with Bihra P.S. Case No. 210 of 2013 for the offence under Sections 467, 468, 471, 420, 406, 409, 120B of the Indian Penal Code.

Heard learned counsel for the petitioner and the State.

The prosecution story, in brief, is that the petitioner illegally withdrawn an amount of Rs. 2,67,980/- from the branch post office, Khadipur.

It is submitted on behalf of the petitioner that the petitioner is the former Ward Member of the Panchayat. It has further been submitted that petitioner has got no criminal antecedent. It is further submitted that withdrawal of Rs. 2,67,980/- made against the petitioner. It is further submitted that petitioner has already deposited an amount of Rs.

Patna High Court Cr.Misc. No.12924 of 2015 (2) dt.21-05-2015 2,55,396/-.

On behalf of the State, it has been submitted that the petitioner is named in the First Information Report. Considering the aforesaid fact that the petitioner has already deposited the said amount, let the above named petitioner, in the event of her arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 210 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
